Monkeying A Round, LLC – GoBoat Rental Liability Waiver & Release Agreement

IMPORTANT: This is a legally binding document. Read carefully before signing.


1. ASSUMPTION OF RISK

I understand that boating involves inherent risks, including but not limited to: drowning, falling overboard, sunburn, heat exhaustion, wildlife encounters, and collision; injuries caused by improper use, weather, or actions of others on the water; use of inflatable vessels with low horsepower motors. I voluntarily accept all such risks, known and unknown, even if they arise from the negligence of the Company or others.

2. RELEASE OF LIABILITY

To the fullest extent permitted by Florida law, I, for myself and anyone who may claim through me, release and hold harmless Monkeying A Round, LLC (“Company” or “Albert”), including its owners, agents, employees, contractors, and affiliates, from all liability for: personal injury or death; loss or damage to property; any claims or demands related to participation in this rental activity.

3. INDEMNIFICATION

I agree to indemnify and defend the Company against any claim, damage, cost, or legal fee arising from: my actions or omissions; any injury or damage to myself, my guests, or third parties; use of the GoBoat in violation of law or Company policies.

4. RESPONSIBILITY FOR MINORS & YOUTH OPERATOR PERMISSION

I understand that minors under the age of 18 are generally not permitted to operate a GoBoat.However, Monkeying A Round, LLC permits minors aged 14 to 17 to operate a GoBoat only if:- I am the parent or legal guardian of the minor;- I grant express permission for the minor to operate the GoBoat during this rental;- The minor is accompanied and directly supervised by me or another responsible adult at all times;- The minor wears a personal flotation device (life jacket) while onboard;- The minor complies with all safety rules, operational instructions, and agrees to respectful behavior on the water.I accept full responsibility and liability for the minor’s actions, safety, and any damage or injuries resulting from their operation of the GoBoat.I hereby authorize the following minor(s), aged 14–17, to operate the GoBoat under these terms:

5. USE REQUIREMENTS

I confirm that:- I am at least 18 years of age.- I will not operate the GoBoat under the influence of alcohol or drugs.- I will wear a personal flotation device (life jacket) at all times.- I understand that while the motor is under 1 horsepower and does not require a boating safety card, I am still responsible for safe operation.- I will pay for any damage caused to the GoBoat due to misuse or negligence.

6. GOVERNING LAW

This agreement is governed by the laws of Florida, and any disputes will be resolved in Pinellas County, FL.
